Terms of Service
The terms that govern your use of ProtectedPets.
1. Acceptance of these terms
ProtectedPets (the “Service,” available at protectedpets.org) is operated by Pagani Enterprises LLC, a Florida limited liability company (“we,” “us,” “our”). By accessing or using the Service, you agree to these Terms of Service and to our Privacy Policy, Accuracy & Use Notice, Acceptable Use Policy, and Copyright / DMCA Policy, each incorporated by reference. If you do not agree, do not use the Service.
2. What ProtectedPets is
ProtectedPets is an animal-welfare transparency platform — a case tracker and a unified search over official government animal-abuse registries and public court records. It is not a privately-curated registry of abusers, not a database we author, and not a people-search utility. Every person-level record is drawn from an official government source and presented with attribution and a link back to that source. We add presentation and search; we do not add accusations.
3. Accuracy disclaimer
Information on the Service is sourced from third-party official government and court records. We strive for accuracy and timeliness, but we do not warrant that any record is accurate, complete, current, or free of error. Official records may be updated, sealed, expunged, corrected, or removed at any time, and there may be a delay before such changes are reflected here. You must verify any information against the official source (linked on each record) before relying on it for any purpose. An absence of results does not mean a person is, or is not, in any registry or court record.
4. Not legal advice; not a consumer report
Nothing on the Service is legal advice. ProtectedPets is not a consumer reporting agency, and the Service is not a “consumer report” as defined by the federal Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq., or any state analog. You may not use the Service, in whole or in part, to make decisions about a person’s eligibility for employment, housing or tenancy, credit, insurance, education, or any other purpose governed by the FCRA or similar law. The Service is for general informational and public-accountability purposes only.
5. Prohibited uses — harassment and vigilantism
You may not use the Service to harass, threaten, stalk, intimidate, locate, contact, or take any action against any individual, or to encourage or incite others to do so. ProtectedPets exists for transparency and public accountability — not targeting. The full list of prohibited conduct is in our Acceptable Use Policy, which you agree to. Violation may result in termination of access and, where appropriate, referral to law enforcement.
6. No scraping or re-targeting
You may not use automated means to bulk-extract, scrape, or harvest data from the Service, and you may not combine, enrich, or cross-reference any data obtained from the Service with home addresses, contact information, or other data in order to build a targeting, “near me,” or contact tool directed at any individual.
7. Corrections and removals
If you believe a record is inaccurate, out of date, or should be removed (for example, a dismissal, acquittal, overturned conviction, sealing, expungement, or mistaken identity), use our correction and removal process. Our handling of such requests, including timelines, is described there and in the Accuracy & Use Notice.
8. Intellectual property and copyright
The Service’s design, original text, and software are owned by us or our licensors. Underlying public records are government records. We respect copyright and maintain a notice-and-takedown process under the Digital Millennium Copyright Act — see our Copyright / DMCA Policy.
9. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by Florida law.
10. Limitation of liability
To the fullest extent permitted by law, Pagani Enterprises LLC and its members, officers, and
agents will not be liable for any indirect, incidental, special, consequential, or punitive
damages, or any loss arising out of your use of, or reliance on, the Service. [Counsel to
finalize any liability cap and carve-outs enforceable under Florida law.]
11. Indemnification
You agree to indemnify and hold harmless Pagani Enterprises LLC from any claim arising out of your misuse of the Service or your violation of these Terms, including any use prohibited by Section 5 or the Acceptable Use Policy.
12. Changes
We may modify the Service or these Terms. Material changes will be reflected by updating the effective date above and, where appropriate, by notice on the Service. Continued use after a change constitutes acceptance.
13. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law
rules. Venue for any dispute lies in the state or federal courts located in
[county] County, Florida. [Counsel to confirm venue, arbitration, and any
class-action-waiver provisions.]
